Synopsis: ON APRIL 23, 1979, A 1978 FORD COURIER PICKUP TRUCK WITH 12 TEENAGED OCCUPANTS, 8 OF WHOM WERE RIDING IN THE OPEN BED, WAS TRAVELING AT A HIGH RATE OF SPEED ALONG A WINDING COUNTRY ROAD NEAR CROFTON, MARYLAND. THE TRUCK FAILED TO NEGOTIATE A CURVE TO THE LEFT, RAN OFF THE RIGHT SIDE OF THE ROAD, AND STRUCK THREE TREES LOCATED ABOUT 7 FEET FROM THE EDGE OF THE PAVEMENT. TEN PASENGERS WERE KILLED AND ONE PASSENGER WAS SERIOUSLY INJURED; THE DRIVER WAS INJURED SLIGHTLY.
Recommendation: THE NTSB RECOMMENDS THAT THE NATIONAL COMMITTEE ON UNIFORM TRAFFIC LAWS AND ORDINANCES: ESTABLISH MODEL GUIDELINES FOR PROHIBITING PASSENGERS FROM RIDING IN OPEN-CARGO AREAS OF VEHICLES THAT ARE NOT BEING USED FOR WORK-RELATED PURPOSES.

Response: H-79-40 WAS ISSUED TO NCUTLO AS A RESULT OF THE BOARD'S INVESTIGATION OF A PICKUP TRUCK ACCIDENT NEAR CRAFTON, MARYLAND, ON 4/23/79. IT ASK THE NCUTLO TO ESTABLISH MODEL GUIDELINES FRO PROHIBITING PASSENGERS FROM RIDING IN OPEN-CARGO AREAS OF VEHICLES THAT ARE NOT BEING USED FOR WORK-RELATED PURPOSES. THE BOARD UNDERSTAND THAT NCUTLO HAS ADOPTED SECTION 11-1118 OF THE UNIFORM VEHICLE CODE, WHICH STATES THAT "NO PERSON, DRIVING A TRUCK WITH A GROSS WEIGHT OF (10,000) POUNDS OR LESS, COMMONLY KNOWN AS A PICKUP TRUCK, OR DRIVING A FLATBED MOTORTRUCK OF ANY WEIGHT SHALL TRANSPORT ANY MINOR UNDER THE AGE OF (18) YEARS SHALL RIDE IN THE BACK OF THE TRUCK. SINCE SECTION 11-1118 PROHIBITS MINORS FROM RIDING IN THE BACKS OF PICKUP TRUCKS, H-79-40 HAS BEEN CLASSIFIED "CLOSED--ACCEPTABLE ALTERNATE ACTION."

Response: THE SUBJECT MATTER OF THIS RECOMMENDATION (RIDING UNRESTRAINED IN PICKUP TRUCKS) HAS BEEN DEBATED REPEATEDLY BY THE NATIONAL COMMITTEE. IN 1992, THE COMMITTEE ADOPTED SECTION 11-1118- "CARRYING PASSENGERS UNSECURED IN REAR," WHICH STATES AS FOLLOWS: 11-1118 CARRYING PASSENGERS UNSECURED IN REAR (A) NO PERSON, DRIVING A TRUCK WITH A GROSS WEIGHT OF (10,000) POUNDS OR LESS, COMMONLY KNOWN AS A PICKUP DRIVING A FLATBED MOTERTRUCK OF ANY WEIGHT SHALL TRANSPORT ANY MINOR UNDER THE AGE OF (18) IN THE BACK OF THE TRUCK & NO MINOR UNDER THE AGE OF (18) YEARS SHALL RIDE IN THE BACK OF THE TRUCK.

Response: From the special study Fatalities and Injuries Associated with Riding in Cargo Areas of Pickup Trucks (NTSB-HSS-81-2) adopted on 9/9/1981. As a result of this study, the National Transportation Safety Board reiterated its recommendation that the National Committee on Uniform Traffic Laws and Ordinances (H-79-40).

Response: MEETING AT NATIONAL COMMITTEE ON UNIFORM TRAFFIC LAWS AND ORDINANCES (NCUTLO) ON JUNE 11, 1981: LACK OF FUNDS HAS PRECLUDED ANY WHOLE-COMMITTEE OR SUBCOMMITTEE MEETINGS, THEREFORE, NO COMMITTEE ACTION. NCUTLO HAS APPROACHED THE NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION TWO TIMES SEEKING FUNDING FOR THIS MODEL LAW DEVELOPMENT (ESTIMATED AT $25,000 TO $50,000) AND HAS BEEN TURNED DOWN BOTH TIMES. THE NCUTLO IS PREPARED TO MOVE ON H-79-40 AS SOON AS FUNDS BECOME AVAILABLE.
