Synopsis: IN 1982, THE NATIONAL TRANSPORTATION SAFETY BOARD INVESTI GATED TWO SEVERE RAILROAD/HIGHWAY GRADE CROSSING ACCIDENTS THAT OCCURRED IN STATES WITHOUT COORDINATED STATEWIDE PROGRAMS AIMED AT REDUCING TRAIN/HIGHWAY-VEHICLE COLLISIONS. IN THE INVESTIGATION OF THESE ACCIDENTS, THE SAFETY BOARD REVIEWED THE RAILROAD ACCIDENT DATA OF ALL THE STATES, INCLUDING MARYLAND, THAT DO NOT HAVE AN "OPERATION LIFE SAVER" PROGRAM IN EFFECT. ACCIDENT STATISTICS INDICATE THAT IN THE 4-YEAR PERIOD FROM 1978 THROUGH 1981 THERE WERE 200 ACCIDENT/INCIDENTS AT RAILROAD/HIGHWAY GRADE CROSSINGS IN THE STATE OF MARYLAND. THESE ACCIDENT/INCIDENTS RESULTED IN 11 FATALITIES AND 70 INJURIES. ALTHOUGH THE NUMBER OF GRADE CROSSING ACCIDENT FATALITIES HAS DECLINED NATIONALLY OVER THE LAST 4 YEARS, THEY HAVE NOT DECLINED IN THE STATE OF MARYLAND.
Recommendation: THE NTSB RECOMMENDS THAT THE STATE OF MARYLAND: ADOPT AN "OPERATION LIFESAVER" PROGRAM AS A FOUNDATION FOR A STATE WIDE EFFORT TO REDUCE ACCIDENTS AT RAILROAD/HIGHWAY GRADE CROSSINGS IN MARYLAND.

Response: STATE OF MARYLAND LETTER: AS REGARDS SAFETY RECOMMENDATION H-82-33, "ADOPT AN 'OPERATION LIFESAVER' PROGRAM AS A FOUNDATION FOR A STATEWIDE EFFORT TO REDUCE ACCIDENTS AT RAILROAD/HIGHWAY GRADE CROSSINGS IN MARYLAND," AN OPERATION LIFESAVER PROGRAM HAS BEEN INSTITUTED. HEREWITH IS A COPY OF A LETTER SENT TO MR. T. C. GILCHREST, PRESIDENT OF THE NATIONAL SAFETY COUNCIL, REQUESTING THAT THE COUNCIL OFFICIALLY RECOGNIZE MARYLAND AS A PARTICIPANT STATE IN OPERATION LIFESAVER. I TRUST THAT THE SAFETY BOARD WILL DEEM THIS ACTION FULLY ACCEPTABLE AND CAN CLOSE SAFETY RECOMMENDATION H-82-33.

Response: STATE OF MARYLAND: THE VARIOUS STATE GOVERNMENT AGENCIES IDENTIFIED IN MY JULY 7 LETTER CONTINUE, ALONG WITH LOCAL GOVERNMENT, RAILROAD AND PRIVATE SAFETY ORGANIZATION OFFICIALS, TO PARTICIPATE IN "OPERATION LIFESAVER." AN "OPERATION LIFESAVER" COMMITTEE HAS BEEN ESTABLISHED WITHIN THE SAFETY COUNCIL OF MARYLAND. I AM ASKING THE DEPARTMENT OF TRANSPORTATION TO ASCERTAIN THE ADDITIONAL STEPS THAT NEED TO BE TAKEN FOR MARYLAND TO BE OFFICIALLY RECOGNIZED AS AN "OPERATION LIFESAVER" PARTICIPANT. I TRUST THAT THE ABOVE INFORMATION PROVIDES THE SAFETY BOARD WITH A CLEARER UNDERSTANDING OF THE EXTENT TO WHICH MARYLAND HAS ACHIEVED THE SAFETY INTENT OF THE BOARD'S RECOMMENDATIONS.

Response: GOVERNOR OF MARYLAND LETTER: IN A PREVIOUS RESPONSE TO THIS RECOMMENDATION I ADVISED YOU THAT IT HAD BEEN REFERRED TO THE MARYLAND DEPARTMENT OF TRANSPORTATION (MDOT) FOR REVIEW. TO THE PRESENT TIME CERTAIN AGENCIES WITHIN MDOT HAVE BEEN INFORMALLY PARTICIPATING IN AND SUPPORTIVE OF "OPERATION LIFESAVER," I.E., THE TRAFFIC ENGINEERING DIVISION OF THE STATE HIGHWAY ADMINISTRATION (SHA) AND THE PUBLIC AFFAIRS AND TRANSPORTATION SAFETY DIVISIONS OF THE OFFICE OF THE ASSISTANT SECRETARY OF ADMINISTRATION (OASA). ALSO INFORMALLY PARTICIPATING HAS BEEN THE OFFICE OF RAIL SAFETY AND HEALTH IN THE DEPARTMENT OF LICENSING AND REGULATION. ANALYSIS BY MDOT SHOWS THAT GRADE CROSSING PROBLEMS ARE NOT REALLY SIGNIFICANT IN MARYLAND. HOWEVER, THE MDOT DIVISION OF PUBLIC AFFAIRS WITH THE STATE RAILROAD ADMINISTRATION (SRA) AND THE OTHER DIVISIONS MENTIONED ABOVE WILL CONTINUE TO ASSIST INFORMALLY THE EFFORTS OF "OPERATION LIFESAVER." FOR THE PRESENT TIME, WE WILL NOT BE UNDERTAKING A FORMAL PROGRAM IN MARYLAND STATE GOVERNMENT.
