Synopsis: ON MARCH 14, 1982, A PRIVATELY OWNED SOUTHBOUND FORD VAN WAS STRUCK BY AN EASTBOUND COMMUTER PASSENGER TRAIN AT A RAIL ROAD/HIGHWAY GRADE CROSSING ON HERRICKS ROAD AND THE MAIN LINE OF THE LONG ISLAND RAILROAD IN MINEOLA, NASSAU COUNTY, NEW YORK. THE FORD VAN, OCCUPIED BY A TEENAGE DRIVER AND NINE TEENAGE PASSENGERS, HAD BEEN DRIVEN AROUND A PROPERLY FUNCTIONING LOWERED GATE WITH FLASHING LIGHTS ONTO THE CROSSING. FOLLOWING THE IMPACT, A MINOR FIRE WAS IGNITED IN THE VAN'S MOTOR COMPARTMENT. THE FIRE WAS QUICKLY EXTINGUISHED BY A LOCAL FIRE DEPARTMENT. NINE OF THE VAN OCCUPANTS WERE KILLED AND ONE PASSENGER WAS CRITICALLY INJURED. THERE WERE NO REPORTED INJURIES TO THE PASSENGERS OR CREW ABOARD THE COMMUTER TRAIN.
Recommendation: THE NTSB RECOMMENDS THAT THE NEW YORK STATE DEPARTMENT OF MOTOR VEHICLES: PROVIDE INFORMATION ON DRIVER'S RESPONSIBILITIES AT GRADE CROSSINGS PARTICULARLY THOSE WITH AUTOMATIC RAILROAD CROSSING GATES AND FLASHING LIGHTS IN THE NEW YORK STATE DRIVER'S MANUAL AND EXAMINATIONS.

ALONGE OF THE NEW YORK GOVERNOR'S TRAFFIC SAFETY COMMITTEE THAT THE NEW YORK STATE DRIVER'S MANUAL & EXAMINATIONS CONTAIN INFO ON A DRIVER'S REPONSIBILITIES AT GRADE CROSSINGS. BASED ON THE INFO RECEIVED FROM MR. ALONGE, H-82-49 HAS BEEN CLASSIFIED "CLOSED--ACCEPTABLE ACTION."

Response: (8/11/94 PHONE CONVERSATION) ACCORDING TO MR. ALONGE OF THE NY GOVERNOR'S TRAFFIC SAFETY COMMITTEE, THE NY DRIVER'S MANUAL & THE EXAMS HAVE BEEN CHANGED TO MEET THE INTENT OF THIS RECOMMENDATION. I'VE INCLUDED PAGE 35 OF THE MANUAL WHICH CONTAINS INFO ON GRADE CROSSING SAFETY.

Response: The Safety Board is pleased that the current New York State Driver's Manual includes information regarding drivers' responsibilities at grade crossings and in particular those crossings with automatic railroad crossing gates and flashing lights. We urge the New York State Department of Motor Vehicles to include questions on such material on the written drivers' license examination at the earliest possible time. Since your action has fulfilled the first part of the recommendation, we will hold Safety Recommendation H-82-49 in an "Open-Acceptable Action" status pending further response.

Response: NEW YORK DEPARTMENT OF MOTOR VEHICLES LETTER: WITH RESPECT TO RECOMMENDATION H-82-49, I REFER YOU TO SECTION 6-5 ON PAGE 39 OF THE NEW YORK STATE DRIVER'S MANUAL. THIS NEW MANUAL, WHICH HAS JUST BEEN PRINTED, WILL BE INTRODUCED AS SUPPLIES OF THE CURRENT JUNE 1981 EDITION ARE DEPLETED. THE POSSIBILITY OF DEVELOPING DRIVER LICENSE WRITTEN EXAMINATION QUESTIONS ON THIS NEW MATERIAL IS STILL UNDER REVIEW.
