Synopsis: ABOUT 7:51 P.M. ON JUNE 21, 1985, A PRIVATELY-OWNED, 70,000 POUND TRACTOR-SEMITRAILER OPERATING IN INTERSTATE COMMERCE UNDER A TRIP-LEASE AGREEMENT WITH C. MAXWELL TRUCKING COMPANY, INC., LOST CONTROL WHILE DESCENDING A STEEP 3,439 FOOT GRADE ON SOUTHBOUND STATE ROUTE 59 IN DOWNTOWN VAN BUREN, ARKANSAS. THE TRUCK COLLIDED WITH THE REAR OF AND OVERRODE A STATION WAGON WHICH WAS STOPPED AT THE BOTTOM OF THE HILL. THE TRUCK AND THE STATION WAGON CONTINUED 84 FEET FORWARD, ACROSS AN INTERSECTION, UP A CURB, AND THROUGH A GUARDRAIL. THEY THEN TRAVELED ANOTHER 22 FEET AND STRUCK TWO COMMERCIAL BUILDINGS. A FIRE ENSUED AND ENGULFED BOTH VEHICLES AND THREE BUILDINGS. BOTH OCCUPANTS IN THE TRUCK AND THE SEVEN OCCUPANTS IN THE STATION WAGON WERE FATALLY INJURED.
Recommendation: THE NTSB RECOMMENDS THAT THE FEDERAL HIGHWAY ADMINISTRATION: MODIFY THE MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES TO INCLUDE SPECIFIC LANGUAGE THAT REQUIRES CONTRACTORS TO MAINTAIN HIGHWAY REGULATORY SIGNS DURING PERIODS OF CONSTRUCTION ON OR ADJACENT TO THE ROADWAY.

THESE SECTIONS ESTABLISH RESPONSIBILITY FOR THE DESIGN, PLACEMENT, OPERATION, AND MAINTENANCE OF TRAFFIC CONTROL DEVICES WITH THE GOVERNMENTAL BODY OR OFFICIAL HAVING JURISDICTION. THE RESPONSIBLE HIGHWAY AGENCY MAY AUTHORIZE PROVISIONS IN THE CONTRACT DOCUMENT TO MAINTAIN THE HIGHWAY REGULATORY SIGNS DURING PERIODS OF CONSTRUCTION.

Response: THE FHWA HAS PUBLISHED A NOTICE OF PROPOSED AMENDMENT TO REVISE MUTCD SECTION 1A-3, "RESPONSIBILITY FOR TRAFFIC CONTROL DEVICES." THE PROPOSED LANGUAGE ADDS A STATEMENT THAT THE JURISDICTION IS RESPONSIBLE FOR NOT ONLY THE DEVICE'S PLACEMENT, BUT ITS EFFECTIVE MAINTENANCE AS WELL. A COPY OF THIS NPA IS ATTACHED. THE OFFICIAL RULING NUMBER IS I-8(C). THE COMMENT PERIOD FOR THIS NPA CLOSES JULY 22, 1988. WE EXPECT THE FINAL RULE FOR THIS CHANGE TO BE INCORPORATED IN THE MUTCD BEFORE THE END OF THE YEAR.

Response: WE BELIEVE THAT THE FIRST SENTENCE OF SECTION 1A-3 OF THE MANUAL, "THE RESPONSIBILITY FOR TRAFFIC CONTROL DEVICES RESTS WITH A MULTITUDE OF GOVERNMENTAL JURISDICTIONS," COVERS THE PROBLEM DESCRIBED IN THE NTSB'S RECOMMENDATION. IN AN EFFORT TO ASSURE THAT NO JURISDICTION MISUNDERSTANDS ITS RESPONSIBILITY FOR MAINTAINING EFFECTIVE TRAFFIC CONTROL DEVICES ONCE THE DECISION IS MADE TO INSTALL A DEVICE AND PRIOR TO A DECISION TO REMOVE IT, WE WILL CONSIDER ADDING A STATEMENT FOLLOWING THE "RESPONSIBILITY" STATEMENT THAT THE JURISDICTION IS RESPONSIBLE NOT ONLY FOR THE DEVICE'S PLACEMENT, BUT, FOR ITS EFFECTIVE MAINTENANCE AS WELL.
