Synopsis: ABOUT 7:51 P.M. ON JUNE 21, 1985, A PRIVATELY-OWNED, 70,000 POUND TRACTOR-SEMITRAILER OPERATING IN INTERSTATE COMMERCE UNDER A TRIP-LEASE AGREEMENT WITH C. MAXWELL TRUCKING COMPANY, INC., LOST CONTROL WHILE DESCENDING A STEEP 3,439 FOOT GRADE ON SOUTHBOUND STATE ROUTE 59 IN DOWNTOWN VAN BUREN, ARKANSAS. THE TRUCK COLLIDED WITH THE REAR OF AND OVERRODE A STATION WAGON WHICH WAS STOPPED AT THE BOTTOM OF THE HILL. THE TRUCK AND THE STATION WAGON CONTINUED 84 FEET FORWARD, ACROSS AN INTERSECTION, UP A CURB, AND THROUGH A GUARDRAIL. THEY THEN TRAVELED ANOTHER 22 FEET AND STRUCK TWO COMMERCIAL BUILDINGS. A FIRE ENSUED AND ENGULFED BOTH VEHICLES AND THREE BUILDINGS. BOTH OCCUPANTS IN THE TRUCK AND THE SEVEN OCCUPANTS IN THE STATION WAGON WERE FATALLY INJURED.
Recommendation: THE NTSB RECOMMENDS THAT THE STATES OF ALASKA, FLORIDA, NEW MEXICO, TEXAS, AND WYOMING: ACTIVELY PARTICIPATE IN THE BUREAU OF MOTOR CARRIER SAFETY'S MOTOR CARRIER SAFETY ASSISTANCE PROGRAM.

Response: Notation 7599 administratively closed H-86-71 -- As part of its investigation of this accident, the Safety Board examined the Bureau of Motor Carrier Safety’s (now the Federal Motor Carrier Safety Administration’s [FMCSA’s]) Motor Carrier Safety Assistance Program (MCSAP). The MCSAP provides participating States with grant funding and training support to improve safety in motor carrier operations. In 1986, only five States (AK, FL, NM, TX, and WY) were not participating in the MCSAP. Consequently, the Safety Board recommended that these five States do the following: "Actively participate in the Bureau of Motor Carrier Safety’s Motor Carrier Safety Assistance Program." Staff verified with the FMCSA that all States now actively participate in the MCSAP. Consequently, the Board has classified Safety Recommendation H-86-71 as "Closed-Acceptable Action" to the five States.

Response: THE TRANSPORTATION DEPARTMENT MADE THE COMMITMENT SEVERAL MONTHS AGO TO PARTICIPATE IN THE COMMERCIAL VEHICLE SAFETY ALLIANCE PROGRAM WHICH WILL BE INITIATED VERY SOON. PARTICIPATION IN CVSA WILL REQUIRE AN ADDED WORKLOAD AT A TIME WHEN WE ARE FACING BUDGETARY AND PERSONNEL CUTS. IT IS THEREFORE IMPRUDENT FOR THE DEPARTMENT TO MAKE ADDITIONAL PROGRAM COMMITMENTS EVEN THOUGH IT RECOGNIZES THE BENEFITS OF A "STATE ENFORCEMENT PLAN."
