Synopsis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
Recommendation: THE NTSB RECOMMENDS THAT THE FEDERAL HIGHWAY ADMINISTRATION: CONDUCT A SAFETY REVIEW(S) OF THE LEATHERWOOD MOTOR COACH CORPORATION WITH SPECIFIC EMPHASIS ON CHECKING THE EMPLOYMENT HISTORY AND DRIVER LICENSE RECORDS OF ITS BUS OPERATORS TO DETERMINE IF THE COMPANY IS IN COMPLIANCE WITH APPLICABLE FEDERAL REGULATIONS.

Response: The Safety Board understands that the FHWA has conducted a safety compliance review of the Leatherwood Motor Coach Corporation and that the violations discovered resulted in an "Unsatisfactory" safety rating. We would appreciate being advised when FHWA completes its follow-up review of this carrier in order to determine if compliance has been achieved--with specific emphasis on checking the employment history and driver license records of its bus operators. This recommendation has been classified as CLOSED—ACCEPTABLE ACTION.

Response: On June 17, 1987, FHWA's region 3 conducted a compliance review on the motor carrier safety operations of leatherwood motor coach corp. During the review, 22 percent of the company's driver qualification files were audited for compliance with the federal motor carrier safety regulations. Violations were discovered in this phase of the review as well as in other areas of the review. As a result of the violations noted on the compliance review, the carrier has been issued an overall "unsatisfactory" safety rating. The carrier has been placed in FHWA's selective compliance and enforcement program where the company's operations are being closely monitored. Another follow up review is scheduled to determine if the carrier has taken any corrective action.
