Synopsis: AT 2:39 P.M. ON 2/9/95, METROPOLITAN TRANSPORTATION AUTHORITY/YORK CITY TRANSIT (NYCT) NORTHBOUND M LINE SUBWAY TRAIN COLLIDED WITH THE REAR CAR OF A STOPPED NYCT B LINE SUBWAY TRAIN. THE COLLISION OCCURRED ON ELEVATED TRACK ABOUT 1,011 FEET SOUTH OF THE NINTH AVENUE STATION IN BROOKLYN, NEW YORK, FOUR NYCT EMPLOYEES & 11 PASSENGERS SUSTAINED MINOR INJURIES. THE BOARD HAS REVIEWED THE 7/26/90, NYCT REAR-END COLLISION THAT INVOLVED KEYING BY WITHOUT PERMISSION IN WHICH THE TRACK, SIGNAL, & TRAINS WERE THE SAME AS IN THIS FEBRUARY 1995 COLLISION. THE RTO WAS INFORMED BY MEMORANDUM AFTER THE NYCT INVESTIGATION THAT THE COLLISION WAS CAUSED "BY THE FAILURE OF THE OPERATOR, OPERATING THE M TRAIN, TO ADHERE TO THE OPERATING RULES RELATIVE TO PASSING RED SIGNALS, & PASSING RED SIGNALS, & FAILING TO PAY PROPER ATTENTION TO THE OPERATION OF THE TRAIN" & WAS ISSUED A RECOMMENDATION BY THE OFFICE OF SYSTEM SAFETY TO "INSTRUCT LOCAL SUPERVISORS TO INCREASE THEIR OBSERVATION OF OPERATOR'S PERFORMANCE IN THEIR AREAS OF RESPONSIBILITY AS A DETERRENT TO IMPROPER TRAIN OPERATION." AFTER THE 3/10/89, REAR-END COLLISION AT THE 103RD STREET STATION, THE BOARD ASKED THE NYCT IN R-90-4 TO CONDUCT RANDOM TESTING, USING RADAR GUNS, OF TRAIN SPEED, WITH SPECIAL EMPHASIS GIVEN TO THOSE LOCATIONS WHERE SPEED RESTRICTIONS ARE IN EFFECT, THE NYCT RESPONDED THAT "OPERATORS ARE REGULARLY MONITORED FOR THEIR ADHERENCE TO POSTED SPEED LIMITS; WE WILL, MANPOWER PERMITTING, INTENSIFY OUR EFFORTS TO ENSURE THAT SPEED RESTRICTIONS ARE STRICTLY OBEY."
Recommendation: THE NTSB RECOMMENDS THAT THE METROPOLITAN TRANSPORTATION AUTHORITY/NEW YORK TRANSIT: REVISE THE OPERATING EMPLOYEE EVALUATION CHECK LIST TO EFFECTIVELY DETERMINE COMPLIANCE WITH OPERATING RULES & INSTRUCTIONS & INCLUDE, AT A MINIMUM, UNANNOUNCED SPEED & SIGNAL TESTS & RADIO COMMUNICATIONS PROCEDURES. PROVIDE STANDARDIZE WRITTEN INSTRUCTIONS FOR ADMINISTERING & GRADING THE EVALUATION CHECK LIST.

Response: THE BOARD NOTES THAT THE NYCT HAS REVIEWED ITS EFFICIENCIY TEST PROGRAM, AS REQUESTED. CONSEQUENTLY, R-96-10 HAS BEEN CLASSIFIED "CLOSED--ACCEPTABLE ACTION."

Response: MR. LAWRENCE G. REUTER, PRESIDENT, METRO TRANSIT AUTHORITY, NEW YORK TRANSIT RESPONDED ON 5/22/96, THAT NYTC HAS TAKEN APPROPRIATE STEPS IN REVISING THE OPERATING EMPLOYEE EVALUATION CHECK LIST BY CONDUCTING RANDOM, UNANNOUNCED RADAR CHECKS OF TRAIN SPEEDS. SINCE JUNE 1995, & WITH THE ADDITIONAL TSS'S, RAPID TRANSIT OPERATION (RTO'S) HAS CONDUCTED OVER 5,800 RADAR CHECKS SYSTEM WIDE. THIS LEVEL OF TRAIN SPEED TESTING WILL BE CONTINUED. IN DECEMBER 1995, RTO DEVELOPED AN "EFFICIENCY TEST PROGRAM" DESIGNED TO MONITOR TRAIN OPERATORS' COMPLIANCE WITH NYCT RULES & REGULATIONS REGARDING KEYING-BY AUTOMATIC SIGNALS. THE PROGRAM WAS GRANTED FINAL APPROVAL ON 1/31/96, BY THE OFFICE OF SYSEM SAFETY (OSS). THE PROGAM WAS INTRODUCED TO ALL RTO EMPLOYEES ON 3/1/96, & THE FIRST TEST WAS CONDUCTED ON 3/5/96. THE TEST ARE CONDUCTED ON A WEEKLY BASIS WITH THE LOCATION & TIME BEING RANDOMLY SELECTED. TO DATE, FIVE TESTS, COVERING ALL TOURS & BOTH SUBDIVISIONS HAVE BEEN CONDUCTED WITH A COMPLIANCE RATE OF OVER 98%. RADIO COMMUNICATION PROCEDURES, BY THE TRAIN OPERATOR, CAN BE EVALUATED AT THE TIME THE TRAIN OPERATOR CONTACTS THE DOS CONTROL CENTER FOR PERMISSION TO KEY-BY. RTO HAS REVISED THE EVALUATION CHECK LIST TO INCLUDE THE REVISED B-FORM. THE REVISED FORM IS CURRENTLY BEING PHASED INTO USE IN BOTH SUBDIVIONS. THE NEW B-FORM INCLUDES THE EVALUATION OF TRAIN OPERATION IN TIMED AREAS & EVALUATION OF THE TRAIN OPERATOR'S UNDERSTANDING OF SIGNALS. THIS INFO WILL BE MAINTAINED IN A DATABASE. ENABLING NYCT TO IDENTIFY PROBLEM AREAS, CORRECT THEM, & TRACK EMPLOYEE PROGRESS. THE SUBDIVISIONS ARE PREPARING WRITTEN INSTRUCTIONS FOR ADMINISTERING & GRADING THE NEWLY DESIGNED EVALUATION CHECK LIST.
