Synopsis: ABOUT 5:38 P.M. ON 2/16/96, EASTBOUND MARYLAND RAIL COMMUTER (MARC) TRAIN 286 COLLIDED WITH WESTBOUND NATIONAL RAILROAD PASSENGER CORPORATION (AMTRAK) TRAIN 29, THE CAPITOL LIMITED, AT MILEPOST 8.55 ON CSX MAIN TRACK NEAR SILVER SPRING, MARYLAND. THE MARC TRAIN WAS OPERATING IN THE PUSH MODE IN REVENUE SERVICE BETWEEN BRUNSWICK , MARYLAND, & WASHINGTON, D.C.; IT CONSISTED OF A LOCOMOTIVE & THREE COMMUTER CARS. THE AMTRAK TRAIN, OPERATING IN REVENUE SERVICE BETWEEN WASHINGTON D.C., & CHICAGO, ILLINOIS, CONSISTED OF 2 LOCOMOTIVES & 15 CARS.
Recommendation: THE NTSB RECOMMENDS THAT THE FTA: COOPERATE WITH CSX TRANSPORTATION INC. IN THE DEVELOPMENT & INSTALLATION OF A POSITIVE TRAIN SEPARATION CONTROL WHERE MARYLAND RAIL COMMUTER EQUIPMENT OPERATES ON CSX TRANSPORTATION INC. TRACKS.

THE BOARD UNDERSTANDS FTA'S ASSERTION THAT IT HAS NO LEGAL AUTHORITY OVER CSXT; HOWEVER, THE FTA'S RELATIONSHIP WITH THE MARYLAND MASS TRANSIT ADMINISTRATION & THE FTA'S COMMITMENT TO EXPEDITE FUNDING IS APPRECIATED. THE BOARD WILL LOOK TO FRA & CSXT FOR THE DEVELOPMENT & INSTALLATION OF A POSITIVE TRAIN SEPARATION CONTROL SYSTEM WHERE MARC EQUIPMENT OPERATES ON CSXT TRACKS. THE BOARD HAS CLASSIFIED R-97-25 "CLOSED--RECONSIDERED."

Response: FTA ADMINISTRATOR GORDON LINTON RESPONDED ON 10/28/97, THAT THE FTA HAS NO REGULATORY AUTHORITY WITH REGARD TO CSX TRANSPORTATION INC. FTA'S RELATIONSHIP IS WITH THE MARYLAND MASS TRANSIT ADMINISTATION, OPERATOR OF MARC. SHOULD THE MTA REQUEST FEDERAL FINANCIAL ASSISTANCE TO UNDERTAKE THE INSTALLATION OF A POSITIVE TRAIN CONTROL SYSTEM ON THE MARC COMMUTER RAIL ROUTES, THE FTA WILL CERTAINLY COOPERATE TO EXPEDITE THE APPROVAL OF SUCH FEDERAL MONIES AS MAY BECOME AVAILABLE.
